So first off, i got sent to Mast for a Pattern of Misconduct i was "awarded" 45/45, reduction in rank (e4 to e3) and 1/2 months x2 (suspended). one of the HMCS' here told me that there is a way to get my crow back. does anyone know anything about this? i know it has to be within 120 days or somethng like that and it has to be from the CO that took it. any help will be appreciated. the skipper told me a few nights ago that he sees that im taking this well, and that i WILL make a good HM3, so im kind of optomistic about this

While I don't have the answer, it saddens me to hear this news, from one of our members. I know it's possible to be separated from military service for Pattern of Misconduct. It appears your CO is giving you the benefit of the doubt and a chance to correct whatever it is that needs to be corrected. Hopefully, somebody else will have additional guidance! We wish you the best. |

Brandon,
Your Senior Chief may be referring to mitigation, remission or setting aside of the remainder of your punishment. Usually this occurs through the actions of whoever the NJP imposing authority was (in this case, your CO), and typically has to be done within 4 months of the original punishment. Per the Manual Of Courts Martials (2008), mitigation is appropriate when the offender's later good conduct merits a reduction in the original punishment. Keep in mind though, that this is only an option that your CO can use, and isn't required at all to reduce the punishment... Best advice is to learn from your mistakes, and come back stronger. Prove that you are capable of being a Petty Officer, and start studying for the next exam. Nothing wrong with having to overcome a little adversity. Everyone screws up somehow, it's all about how you learn from it.

The problem is that the term "Pattern of Misconduct" shows that multiple incidents of some sort have happened. It makes me wonder what sort of prior disciplinary actions were given before Mast.
I worked DL / DR at 32nd St. for about five months while waiting on my sinus surgery because I wasn't fit for sea duty thanks to the pain medication I had to take. PM me with the circumstances of the events prior to the Mast plus the full details of each offense leading to "Pattern of Misconduct" charge. I will see what I can do to assist you since I know some of the codes from helping the sailors work on some cases. |
